Modo Yoga provides franchisees with a defined territory where it agrees not to open or license another studio using its brand during the term of the Franchise Agreement.
The boundaries of this territory are described in the agreement’s schedule and are based on geographic mapping data. However, this protection ends if the franchisee does not renew, at which point Modo Yoga can open new studios in the former territory.
Although franchisees are granted a territory, Modo Yoga emphasizes that this does not constitute exclusivity. Franchisees may still face indirect competition from the Franchisor through online sales, national promotions, or brand extensions, and no rights are granted to solicit clients outside their territory.
