Initial Training Program

  • Held at the franchisor's headquarters, a regional office, or another specified location.
  • Covers crucial operational procedures, techniques, and system knowledge.
  • Requires passing tests to the franchisor's satisfaction at the end of the training.
  • All related costs, including travel, accommodation, and employee wages, are the franchisee's responsibility.

Ongoing Training

  • Mandatory or optional ongoing training for the Designated Manager may be required, limited to one session per calendar year and not exceeding three days annually.
  • The franchisor may impose a fee for ongoing training.
  • Franchisee bears all related expenses.

Enrichment Training

  • Necessary if the franchisee fails to meet the minimum performance standards.
  • Focuses on improving operational skills and adherence to the franchisor's guidelines.

Additional Training

  • Provided if the Designated Manager does not satisfactorily complete the initial training.
  • Any new Designated Manager must complete the initial training within sixty days.

Territory Protection

The franchisor provides franchisees with territory protection, designating a specific area known as the Protected Area. This area is mutually agreed upon and defined by various boundaries, such as ZIP codes, political boundaries, geographic markers, roads, or other indicators.

Within this Protected Area, the franchisor ensures that neither they nor another franchisee will operate, guaranteeing the franchisee a designated territory to market and deliver services.

However, it's crucial to understand that while franchisees receive a Protected Area, they do not have an exclusive territory. The franchisor retains the right to use other distribution channels, including the internet, to solicit orders from customers within the franchisee's Protected Area using the franchisor's principal trademarks or other competitive brands under the franchisor's control.
