Créatif offers its franchisees a defined territory in which to operate, but this territory is not exclusive. While the franchisor agrees not to authorize or open another dedicated Créatif outlet within that territory for the duration of the franchise agreement, it retains broad rights to distribute products and services through alternative channels such as schools, retail stores, events, and the internet.
Franchisees are restricted to selling and advertising within their approved territory, although advertising reach may naturally extend beyond. The franchisee’s limited territory protection is contingent on their compliance with the agreement, and no minimum sales or performance metrics are required to maintain that protection.
However, Créatif explicitly reserves the right to continue or initiate commercial partnerships or national accounts, even within a franchisee’s area, if the franchisee declines to service those accounts.
