Funtastik Labs provides its franchisees with a Designated Territory once a location is approved, generally extending about three miles from the Center. Within this territory, and as long as the franchisee complies with their obligations, the franchisor agrees not to open another Center using the Funtastik Labs name.
However, this territory is not exclusive, and franchisees may still face competition from other franchisees or company-owned outlets nearby.
The franchisor retains Reserved Rights to operate or license other businesses under different trademarks, or offer similar services through alternative channels like the internet, catalogs, or direct marketing—even within the franchisee’s territory.
Additionally, there are no restrictions preventing Funtastik Labs from soliciting customers or fulfilling orders from inside the Designated Territory using any method or mark it chooses. This means that while some geographic protection exists, it does not fully shield franchisees from indirect or alternative forms of competition.
