Stemtree provides comprehensive training programs for franchisees to ensure the effective operation of the franchised business. The training programs offered by the franchisor include:
Initial Training Program The Designated Manager and up to one assistant must attend and successfully complete an initial training program pertaining to the operation and administration of the Franchised Business. This training is conducted at Stemtree’s headquarters or another location designated by the Franchisor. Although tuition is free, franchisees are responsible for travel, lodging, and salary expenses.
Opening Assistance Stemtree provides guidance for the grand opening of the franchised location. Additional assistance beyond the initial support may be requested, but it will incur fees based on the franchisor’s standard rates plus expenses.
Ongoing Training Throughout the term of the agreement, Stemtree may require the Designated Manager to attend ongoing training programs or seminars. No tuition is charged for mandatory ongoing training; however, the franchisee must cover travel and related costs.
Training for New Designated Managers If a new Designated Manager is appointed after the business begins operations, they must complete the initial training program to the franchisor’s satisfaction. This training is offered without a tuition fee, but associated costs are the responsibility of the franchisee.
Territory Protection
Stemtree grants its franchisees an exclusive territory, which is defined by geographic markers such as radius, zip codes, or natural boundaries. Within this territory, Stemtree promises not to open another company-owned or franchised outlet selling the same or similar goods and services under the same or similar trademarks.
Franchisees’ rights to their territory do not depend on achieving a certain sales volume or meeting other contingencies. However, Stemtree retains the right to solicit or accept orders from consumers inside the franchisee’s exclusive territory through various direct marketing channels, such as the internet, catalogs, or telemarketing.
While Stemtree will not establish competing outlets in the assigned area, it does not compensate franchisees for sales made through these alternative methods within their territory. Additionally, the franchise agreement does not grant options or rights of first refusal to acquire additional territories.
