Training

NextHealth provides a structured training program to ensure that franchisees and their staff are adequately prepared to operate the business effectively. The training includes the following programs:

1. Initial Training Program: Required for the Managing Owner, General Manager, Nurse Practitioner, and Aesthetic RN. The training covers operational standards and is scheduled and structured at the franchisor’s discretion. The first two trainees (Managing Owner and General Manager) attend at no charge, while others must pay a training fee.
2. Training for Replacement Staff: If any of the initial trainees are replaced, the new individuals must complete the same initial training to the franchisor’s satisfaction before assuming their roles.
3. Training Materials: These include operations manuals and team-specific materials, focusing on non-regulated activities. Trainees not bound by the franchise agreement must sign a confidentiality agreement.
4. Additional or Remedial Training: NextHealth may require further training for existing or new staff if deemed necessary. This training is conducted at the franchisor’s discretion and may incur additional costs depending on the role and number of participants.

Territory Protection

NextHealth provides franchisees with defined territorial protections within a designated area. During the term of the Franchise Agreement, as long as the franchisee remains in compliance, the franchisor agrees not to operate or authorize others to open another NextHealth Center within that territory.

These protections also apply under the Area Development Agreement, which outlines specific development areas where franchisees can open multiple locations. However, NextHealth's territorial protections are limited in scope.

The franchisor retains the right to operate or license businesses outside the protected areas and may engage in various activities that overlap with franchise operations, including developing competing brands, using alternative trademarks, and selling services through online or catalog platforms.
