Territory Protection

The franchisor offers territory protection under specific conditions detailed in the Franchise Agreement. The assigned territory is determined based on various demographics and characteristics, such as population density, home values, average income, and more. Franchisees are granted a license for a designated geographical area encompassing up to 300,000 people, referred to as the "Population Limit."

Franchisees are prohibited from relocating their territory or establishing additional irrigation businesses without obtaining prior written consent from the franchisor. This consent may be withheld at the franchisor's sole discretion. Requests for relocation or expansion are assessed individually, taking into account the franchisee's compliance with the Franchise Agreement, the availability of territory, and other relevant factors.

It is important to note that while franchisees do not receive exclusive territories, the franchisor retains the right to establish or license another person or entity to establish an irrigation business using the franchised marks within the franchisee's territory, provided the franchisee is in full compliance with their obligations.
