Tom N Toms Coffee offers franchisees an exclusive territory, with the size determined by whether the location falls within a “Business Zone.” If the franchise is situated in a Business Zone—an area designated by the franchisor with a high concentration of commercial activity—the protected area extends 0.2 miles from the franchise location.
If the location is outside a Business Zone, the exclusive territory is extended to a 0.5-mile radius.
While this exclusive territory restricts the franchisor from opening or franchising another Tom N Toms Coffeehouse within the defined area, it does come with exceptions. The franchisor retains the right to distribute products through grocery stores, convenience outlets, or other retail and wholesale channels, even within a franchisee’s protected territory.
