Men In Kilts grants franchisees a defined Territory, typically made up of at least 40,000 qualified households, based on zip codes or physical boundaries. While the franchisor agrees not to open or license another Men In Kilts location within this Territory, franchisees must comply with agreement terms to maintain these rights.
Franchisees may only perform services outside their Territory with written permission and are prohibited from encroaching on another franchisee’s area. Although Men In Kilts protects a franchisee’s assigned Territory, it reserves the right to operate or license businesses under different names or marks, both inside and outside the Territory.
If the franchisor authorizes service in unassigned areas and later grants a new franchise there, the existing franchisee must stop serving those customers without compensation.
