Pre-Opening Training and Support:
KidsPark provides a limited form of territory protection to its franchisees. While the franchise agreement may grant an exclusive territory, this protection is conditional and may be reduced or revoked if certain performance benchmarks are not met. Specifically, KidsPark reserves the right to modify or reduce the franchisee’s territory if the center fails to maintain enrollment of at least 1,000 families after 20 months of operation.
Moreover, KidsPark may allow other franchisees or the company itself to open centers within a designated area if the original franchisee does not secure an approved site within the initial 90 days of the agreement, or within a 90-day extension period.
This means territory exclusivity is not guaranteed indefinitely and depends on the franchisee’s timely progress and performance.
